These terms are an agreement between you and Tinstac LLC, doing business as nstinx ("nstinx", "we", "us"), for the nstinx mobile apps, watch apps and this website (together, the "Service"). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you don't agree, please don't use the Service. Questions: support@nstinx.com.
1. nstinx is not medical advice
nstinx helps you keep track of your baby's day and your pregnancy, and shares general information. Nothing in the Service, including logs, patterns, "next likely" times, reminders, Ask Bex answers, guides, articles and food checks, is medical advice, a diagnosis or a substitute for your doctor, midwife or other health professional. Always ask them about your health or your baby's health. If you think you or your baby may be having an emergency, call 911 (or your local emergency number) right away.
2. Who can use nstinx
You must be at least 13 to create an account. We ask your age once when you sign up, or use the age range your phone's app store shares where it does. If you are under 18, you can use the tracking features, but the Village opens when you turn 18. You must give us accurate information and use the Service only where it is legal for you to do so.
3. Your account and your family
- You sign in with an email address and password. Keep your password safe; you are responsible for activity on your account.
- A family is one or more babies and the people you invite to help care for them. The person who pays for the family's plan is its lead. Parents can invite other caregivers and choose what each one can see and do. Anyone you invite can see the information you give them access to, so invite people you trust.
- Logs, photos and records you add belong to your family. If someone leaves or is removed, their access ends; what they logged stays with the family.
4. Ask Bex
Ask Bex is an AI helper. It answers from your family's logs, our own guides and, for everyday care, a short list of trusted sites. It does not answer health or medical questions: questions about symptoms, medicine, development or whether something is normal get a card pointing you to your pediatrician, and urgent warning signs get a card pointing you to emergency services. Answers can be incomplete or wrong, so check anything important with a professional. To answer, your question and the parts of your logs it needs are sent to service providers who process them for us and may not use them for anything else. Ask Bex has monthly usage limits; when you reach them, answers come from your logs and our guides until the next month. You can report an answer from the app, and we review reports.
5. Visits and recordings
You can record a doctor's visit to get a transcript and notes. Only record when everyone in the room agrees; the app asks you to confirm that each time, and you are responsible for following the recording laws where you are. The audio is deleted once the transcript is made. Visit notes are a convenience, not a medical record; your provider's records are the official ones.
6. Plans and billing
- Plans. nstinx has a Free plan and paid plans (Solo, Duo and Crew), billed monthly or yearly, and some plans can be bought once for life. What each plan includes and its current price are shown in the app before you buy. A family's paid plan covers everyone in that family. If the lead's plan ends, the family moves to the Free plan; nothing you logged is deleted.
- Buying in the app. Purchases made in the app are billed by Apple or Google to your app store account. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel them in your app store account settings; deleting the app doesn't cancel them. Refunds for these purchases are handled by Apple or Google under their policies. Purchases from the App Store are also subject to Apple's standard Licensed Application End User License Agreement.
- Buying on the web. Plans bought on our website are billed by us through our payment processor, renew automatically until you cancel, and can be canceled anytime from Plan & billing in the app or the billing page it opens. When you cancel, your plan stays active until the end of the period you paid for. For a refund on a web purchase, email support@nstinx.com.
- Lifetime. A lifetime purchase gives you that plan for as long as we offer the Service, with no renewals.
- Price changes. If a subscription's price goes up, we (or the app store) will tell you before it applies, and you can cancel before then.
7. Referral and partner programs
You can share your code with friends. A friend who subscribes on the web with your code gets the discount shown in the app, and you get a free month (on a web plan it moves your renewal back a month; otherwise it adds a month of Solo). Partners earn commissions instead, as described in Program terms in the app, which form part of these terms. One code per family; the first code used wins. Codes work only with web checkout. Earnings are never more than what a family actually paid us; refunds and chargebacks come off future payouts. Be honest that you're sharing a code: no spam, no paid search ads on our name, and no promises of medical results. We may withhold rewards obtained through fraud or self-referral, and we may change or end either program with 30 days' notice in the app; earnings that have already cleared are still paid.
8. The Village
The Village is our community for parents. It is text-only, and members see each other only by their Village name. By posting, you agree to:
- Be kind. No harassment, hate, threats or sexual content, and nothing that sexualizes or endangers a child.
- Keep it anonymous. Don't share anyone's real name, contact details, photos or location, including your own.
- Not give medical, legal or financial advice as if you were a professional, and not spread health claims you know to be false.
- Not sell, advertise, recruit or spam.
Posts and messages are checked automatically and by people. We may hide or remove content, limit features or close accounts that break these rules, and when a post suggests someone may be in danger, we show them where to get help right away. You can report and block anyone. The Village is for support between parents; it isn't monitored around the clock and isn't a crisis service.
9. Your content
You own what you add to nstinx. You give us a license to store, process and display it only to run and improve the Service for you, your family and, for Village posts, other members. When you delete content or your account, this license ends, except for copies we must keep for legal reasons and Village replies others have built on, which stay with your name removed.
10. Things you may not do
- Break the law or anyone's rights using the Service.
- Access another person's account or family without permission, or try to get around the access a parent has set.
- Copy, scrape, reverse engineer, overload or interfere with the Service, or use it to build a competing product.
- Upload anything harmful, such as malware, or anything you don't have the right to share.
11. Ending your account
You can delete your account anytime in Settings. Your account is closed right away and deleted after 30 days; signing back in before then restores it. Deleting your account doesn't cancel a subscription bought through an app store, so cancel that first. We may suspend or close an account that breaks these terms or puts others at risk. Sections 1, 9 and 12 to 15 continue after your account ends.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy. We don't promise the Service will always be available, error-free or that reminders and notifications will always arrive on time, so don't rely on nstinx alone for anything time-critical, such as medicine doses.
13. Limitation of liability
To the fullest extent the law allows, nstinx will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not all apply to you.
14. Indemnity
If you break these terms or the law, or your content harms someone, and that leads to a claim against us, you agree to cover our reasonable costs, including legal fees.
15. Governing law and disputes
These terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it informally. Any claim not resolved that way will be brought in the state or federal courts located in Maryland, and you and we consent to their jurisdiction, unless the law where you live gives you the right to bring it locally.
16. Changes to these terms
If we make material changes, we will update the effective date above and tell you in the app or by email at least 30 days before they take effect. If you keep using the Service after that, the new terms apply.
